Accommodation provider confirmation; submission
When you move into a new apartment, you need a confirmation from your landlord that you have moved in. You must present this to the registration office each time you register.
Description
Since 01.11.2015, the housing provider has been obliged to cooperate in the registration of a dwelling. Section 19 of the Federal Registration Act stipulates that the housing provider or a person appointed by him/her must issue a confirmation of move-in to the person obliged to register for submission to the registration office:
The housing provider is the person who makes the dwelling (a dwelling within the meaning of the Federal Registration Act is any enclosed space used for living or sleeping) available. Housing providers are primarily landlords or their agents, e.g. housing administrators. Housing providers can also be homeowners themselves, as well as primary tenants who sublet their living space.
The housing provider confirmation must contain the following information:
- Name and address of the housing provider and, if the housing provider is not the owner, the name of the owner as well.
- the date of moving in
- the address of the dwelling
- the names of all persons subject to registration who are moving in
The tenancy agreement does not meet the requirements laid down by law, as it does not usually contain all the information required.
The confirmation of the landlord can also be made electronically to the registration office. For this purpose, the landlord receives an assignment feature from the registration office, which he/she must provide to the person subject to registration for use when registering.
Procedure
You will receive the housing provider confirmation from your landlord.
Landlords also have the option of submitting the confirmation electronically to the registration office if the municipality/city administration has opened a corresponding access. In this case, you will receive a so-called assignment feature from your landlord, which will be communicated to him by the registration office.
When you register at the registration office, you present the landlord's confirmation or state the allocation feature.
Special notes
If the housing provider does not issue the confirmation, does not issue it correctly or does not issue it in time, he commits an administrative offence that can be punished with a fine of up to EUR 1,000.
Deadlines
The housing provider is obliged to issue the confirmation no later than two weeks after you move in.
If the housing provider refuses to issue the confirmation or if it is not possible for you to receive the confirmation for other reasons, you must inform the registration office immediately.
