German nationals (regardless of the place of residence) and german legal entities.

EU foreigner

Individuals who are nationals of another EU Member State (regardless of the place of residence) and legal entities formed under the law of a Member State and having their registered office, central administration or principal place of business within the EU. Nationals and legal entieties of Norway, Iceland and Liechtenstein are considered equal to EU citizens.

Non-EU foreigner

Nationals of other countries and legal entities not governed by the laws of EU Member States or the law of Liechtenstein, Norway or Iceland.

You are practicing a cross-border service if you are pursuing your activity in Bavaria

  • temporarily with and without a fixed establishment or
  • for an indefinite period without a fixed establishment from a branch in a EU or European Economic Area (EEA) member state.

You are operating with a branch office in Bavaria if you practice your acitivity for an indefinite period in Bavaria (such as in offices, storage facilities or production plants).

Note to activity or establishment in another German federal state

If you work

  • with a branch in Bavaria and also wish to pursue a job in another German federal state for an indefinite period or
  • want to exercise your activities in Bavaria temporarily from a branch in another German federal state
