Construction products; application for notification as testing laboratory or certification body

In order to be able to participate in the assessment and verification of constancy of performance of construction products within the framework of CE marking, independent third-party bodies (testing laboratories and certification bodies) require notification.

Description

The Construction Products Regulation (CPD) requires notification for bodies authorized to carry out third party tasks for assessment and verification of constancy of performance.

Depending on the extent of involvement in the assessment and verification of constancy of performance of construction products (AVCP system), the CPD distinguishes three types of notified bodies:

  • Notified testing laboratories for establishing the performance of the construction product (AVCP system 3),
  • Notified factory production control certification bodies for verification and certification of the manufacturer's factory production control (AVCP system 2+),
  • Notified Product Certification Bodies for certification of constancy of performance of the construction product (AVCP system 1 and 1+).

The AVCP systems are regulated in detail in Annex V of the Construction Products Regulation. The basis for the activity of the notified bodies (NB) is the respective technical specification and the defined AVCP system.

Prerequisites

The most important requirements for notified bodies include impartiality, absence of conflicts of interest, technical competence, sufficient experience, and suitable premises and technical equipment.

The requirements are regulated in detail in Article 43 of the Construction Products Regulation.

A prerequisite for notification is accreditation by the Deutsche Akkreditierungsstelle GmbH (DAkkS). As part of this procedure, DAkkS also checks whether the specific requirements of the Construction Products Regulation (Article 43) are met.

Procedure

Submit the accreditation certificate(s) including annexes together with the completed application form(s) to the Institut für Bautechnik (DIBt).

If the requirements for acting as an independent third party are met, DIBt issues a corresponding notification and notifies the body to the European Commission and the other EU member states.

    • Horizontal notification: 1,000 to 10,000 EUR
    • Extension and amendment of notification: 250 to 5,000 EUR
    • Revocation and withdrawal of notifications: 500 to 10,000 EUR
    • Official acts within the framework of the inspection of notified testing and certification bodies, insofar as these do not lead to the revocation or withdrawal of notifications: per working hour or part thereof, fee in accordance with tariff item 5 letter e) of the schedule of fees of the German Institute for Structual Engineering
