Wine law; application for the registration of a vineyard name or a Gewann in the vineyard register

All Bavarian vineyards that can be used as a permitted geographical designation of origin for quality wines are entered in the vineyard register. Now this possibility also exists for Gewanne.

Description

For quality wines, Prädikat wines, quality liqueur wines psr, quality semi-sparkling wines psr and sparkling wines psr, only site names that are registered in the vineyard register and whose vineyards are located in one or more municipalities of the same growing region may be used as geographical designations of origin. For quality wines and Prädikat wines, only Gewanne designations may be used if they are registered in the vineyard register and if the wines meet the strict requirements of § 19 para. 11 BayWeinRAV.

Prerequisites

The name of the vineyard must be traditional for the vineyard area belonging to the vineyard or registered in the land register or be based on such a name. The minimum size is 5 ha, which may be undercut in exceptional cases. It must be possible to produce equivalent wines of similar taste from the yields. Delimited smaller geographical units within the meaning of § 23 Para. 1 No. 2 of the Wine Law (Gewanne) registered in the real estate cadastre may be entered in the vineyard register.

Procedure

The informal application is to be submitted with all attachments (maps on a scale of 1 : 2,500 or 1: 5,000) in at least 5 copies to the municipality in which the site is wholly or predominantly located. The municipality submits the application together with its statement directly to the government of Lower Franconia, which makes a final decision on the application. In the case of an application for a Gewann, the application must also be accompanied by a current real estate map with the Gewann name entered there, a list of the parcels located entirely in the Gewann and a current area and use certificate showing that the applicant is farming a parcel in the Gewann applied for at the time of application.

The application is not bound to any time limit.

In individual cases, processing can take up to several months.
