For the operation of an unmanned aerial vehicle in a geographical area in accordance with Section 21h (3) and (4) of the German Aviation Ordinance, you may apply for deviations from the specified operating conditions in justified cases.
Description
The generic term "unmanned aerial systems" covers unmanned aerial systems (colloquially "drones") and model aircraft. Unmanned Aircraft Systems (UAS) are unmanned aerial vehicles, including their control station, that are not operated for sports or recreational purposes. This includes, for example, quadro/hexa/octocopters for commercial photography, advertising airships, and also model aircraft when used for commercial purposes.
When used for sports or recreational purposes, they are model aircraft. Legally, model aircraft and unmanned aerial systems are treated largely the same as unmanned aerial vehicles.
Since 31.12.2020, the Implementing Regulation (EU) 2019/947 on the rules and procedures for the operation of unmanned aerial vehicles applies in principle to the operation of unmanned aerial systems. In addition, some provisions of national law for the operation of unmanned aerial vehicles must also be observed. In justified individual cases, exemptions from the regulations of § 21 h LuftVO can be permitted according to § 21 i para.1 LuftVO. You will find the corresponding application under "Forms".

The online course and the online theory exam for the proof of competence open subcategory A1/A3 can be found on the learning portal of the LBA (see "Related links").
You can take the proof of competence open subcategory A2 at one of the testing centers for remote pilots (PStF) designated by the LBA (see "Related links").
