Statutory health insurance funds and accident insurance institutions; application for approval of service regulations and job plans
The service regulations and job plan of a health insurance fund or accident insurance institution require the approval of the competent supervisory authority.
Service regulations must be established for employees paid by health insurance funds who are not state or municipal officials. The service regulations shall regulate the legal and general service relationships of the employees, in particular the proof of their professional qualification, their number, the manner of employment, termination or dismissal and the consequences of non-fulfillment of duties.
The service regulations shall require the approval of the Representatives' Meeting and the approval of the supervisory authority. Approval may only be refused if there is good cause, in particular if the number or remuneration of the employees is conspicuously disproportionate to their duties. The same applies to changes in the service regulations.
The Executive Board shall draw up service regulations and a staffing schedule for employees paid by accident insurance institutions. The service regulations and the staffing plan shall be subject to the approval of the representatives' meeting and the approval of the supervisory authority.
In the area of social insurance, the higher insurance offices are supervisory authorities over the state-unaffiliated corporations under public law and over the working groups under the supervision of the Free State of Bavaria.
