Statutory health insurance; request for approval of service regulations and staffing plans.
The service regulations and the staffing plan of a health insurance fund shall be subject to the approval of the competent supervisory authority.
Description
Service regulations must be drawn up for employees paid by health insurance funds who are not state or municipal civil servants. The service regulations shall regulate the legal and general service relationships of the employees, in particular the proof of their professional qualification, their number, the manner of employment, termination or dismissal and the consequences of non-fulfillment of duties.
The establishment of the service regulations shall require the consent of the Board of Directors and the approval of the Supervisory Authority. The approval may be refused only if there is an important reason, in particular if the number or salary of the employees is conspicuously disproportionate to their duties. The same shall apply to the amendment of the service regulations.
In the field of social insurance, the higher insurance offices are supervisory authorities over the state-unaffiliated public corporations as well as over the labor pools under the supervision of the Free State of Bavaria.
