Description

Governments are the competent authority for driving instructor training centers under section 3 of the FahrlG.

They are also responsible for

the recognition

• of instruction seminars held by a professional association of driving instructors for training driving instructors (Section 16 (1) sentence 2 FahrlG),
• of instruction seminars of a professional association of driving instructors for operators or managers of a training driving school (§ 35 Para. 1 Sentence 2 No. 2 FahrlG),
• the sponsors of instruction courses for applicants for the advanced seminar permit (§ 45 Para. 3 Sentence 3 FahrlG),
• the sponsor of advanced training courses in accordance with § 53 Para. 1 FahrlG and training driving instructors and the management of training driving schools in accordance with § 53 Para. 3 FahrlG (§ 53 Para. 10 FahrlG).

The Government of Upper Bavaria is responsible, among other things, for

• the establishment of the examination board for driving instructor examinations (§ 1 of the Driving Instructor Examination Ordinance),
• the appointment of the members of the examination board and the designation of the chairman (§ 3 Para. 1 Sentence 1 of the Driving Instructor Examination Ordinance).

The government of the Upper Palatinate is responsible for

• checking the information provided on the spot in the case of applications for the granting of a driving instructor permit (§ 22 Para. 3 Sentence 1 FahrlG, § 23 Para. 5 Sentence 2 FahrlG, § 24 Para. 6 Sentence 2 FahrlG) or for the recognition of a driving instructor training center (§ 38 Para. 3 Sentence 1 FahrlG), insofar as this is initiated by the competent authority,
• the receipt of a list of participants in the traffic education submeasure of the driving aptitude seminar for the purpose of monitoring (§ 46 Para. 5 Sentence 2 No. 4a FahrlG),
• the recognition of course instructors of instruction courses for applicants for the traffic education seminar permit (§ 47 Para. 1 Sentence 1 FahrlG),
• the recognition of institutions for the implementation of introductory seminars for course leaders of instruction courses for the acquisition of the seminar permit postgraduate seminar (§ 48 sentence 1 FahrlG),
• the recognition of institutions for the implementation of introductory seminars for course leaders of instruction courses for applicants for the seminar permit traffic education (§ 48 sentence 1 FahrlG),
• the recognition of the sponsors of advanced training courses for holders of a seminar permit postgraduate seminar (§ 53 paragraph 10 FahrlG),
• the recognition of the providers of advanced training courses for holders of a traffic education seminar permit (§ 53 para. 10 FahrlG),
• the supervision of the aforementioned persons and institutions mentioned in § 51 Para. 1 FahrlG (§ 51 FahrlG, § 15 of the Implementing Regulation to the Driving Instructor Act). Supervision also includes, in particular, quality assurance orders in accordance with § 16 Para. 1 of the Implementing Regulation to the Driving Instructor Act, their follow-up control in accordance with § 16 Para. 2 of the Implementing Regulation to the Driving Instructor Act, and the prosecution and punishment of violations. This does not affect the duties and powers of the licensing authorities, recognition authorities and approval authorities;
• the approval of the framework curriculum for basic training for pedagogically extended supervision (Section 15 (2) sentence 2 of the Implementing Regulation to the Driving Instructor Act)
• of the framework curriculum for the advanced training course of the supervision personnel assigned to assess the pedagogical quality (§ 15 para. 3 sentence 2 of the Implementing Regulation to the Driving Instructor Act)
• the approval of a quality assurance system in accordance with Section 51 (7) sentence 1 of the Driving Instructor Act.

In cases other than those mentioned above, the district administrative authorities are the competent authority under Section 50 (1) of the Driving Instructor Act for the enforcement of the Driving Instructor Act and the legal ordinances issued on the basis of this Act.
