Any person who commercially supplies or makes available to third parties substances or mixtures that are labelled with the hazard pictogram GHS06 (skull and crossbones) or with the hazard pictogram GHS08 (health hazard) in accordance with Regulation (EC) No. 1272/2008 (CLP Regulation) with the hazard pictogram GHS06 (skull and crossbones) or the hazard pictogram GHS08 (health hazard) and the signal word Danger and one of the hazard statements H340, H350, H350i, H360, H360F, H360D, H360FD, H360Fd, H360Df, H370 or H372, requires the permission of the competent authority or must notify the competent authority.

In Bavaria, the Trade Supervisory Office at the Government of Lower Bavaria is responsible for issuing a permit or receiving a notification in accordance with the ChemVerbotsV.

Prerequisites

Permission is granted to anyone who

  1. has demonstrated expert knowledge in accordance with § 11 of the Chemicals Prohibition Ordinance,
  2. has the required reliability and
  3. is at least 18 years old.

At least one person who fulfills the above-mentioned requirements must be named in the notification.
