Waste wood; application for notification as a body for conducting investigations.
The Bavarian State Office for the Environment announces bodies that operators of certain waste wood treatment plants must commission in order to comply with their obligations under the Waste Wood Ordinance to arrange for certain examinations of waste wood.
Description
The Waste Wood Ordinance obliges operators of waste wood treatment plants for the processing of waste wood for the production of wood materials to have tests on the pollutant content of waste wood carried out every four quarters. In principle, these operators only comply with these testing obligations if they have the prescribed tests carried out by bodies that have been notified by a competent authority.
In the procedure for the notification of a body, it is checked whether the prerequisites for the notification of the applicant for the performance of the tests stipulated in the AltholzV are fulfilled (cf. the following "Prerequisites").
Prerequisites
A body shall be notified to carry out inspections in accordance with the Waste Wood Ordinance only if the applicant:
- is reliable and has the necessary independence to carry out such third-party inspections,
- has the necessary expertise to carry out such third-party inspections, and
- has the necessary technical equipment for the performance of such third-party inspections.
Deadlines
The applicant does not have to observe any deadlines when submitting the application for disclosure as a body.

Undertaking to allow the representative of the State Office for the Environment access to the laboratory and to the laboratory work during normal business hours.

Declaration of commitment to keep all samples examined for one year for subsequent examinations by the State Office for the Environment.

For applicants from the EU or EEA foreign countries
equivalent foreign certificates shall also suffice in addition to the above-mentioned certificates of expertise and reliability if these certificates show that the above-mentioned requirements are met or that the requirements of the foreign country are essentially comparable with these requirements. The State Office for the Environment may require the submission of a certified German translation of such foreign certificates.
