Description

In the case of experts for spent battery disposal established in other EU/EEA countries who only wish to carry out expert activities provided for in the Battery Act (BattG) on a temporary and occasional basis in Germany, the professional qualification required for this purpose is verified and confirmed.

In the procedure for approving a take-back system for spent portable batteries, the approval authority must rely on an expert opinion from an independent expert to determine whether the approval requirements have been met (expected achievement of the collection targets and requirements for disposal and nationwide take-back, in each case in relation to spent portable batteries).

The take-back system must commission an expert with the appraisal who has been publicly appointed in accordance with § 36 of the Trade, Commerce and Industry Regulation Act (Gewerbeordnung) for the disposal of used batteries.

However, these obligations are also fulfilled if an expert is commissioned who is established in a foreign country of the EU/EEA, who intends to perform expert activities provided for in the Battery Act only occasionally and temporarily in Germany, and whose professional qualification required for this purpose has been verified and confirmed by the competent authority.
