In the case of experts for WEEE disposal established in other EU/EEA countries who only temporarily and occasionally wish to certify initial treatment facilities in Germany within the meaning of the Electrical and Electronic Equipment Act (ElektroG), the professional qualification required for this is verified and confirmed.
Operators of facilities for the initial treatment of WEEE must have their facilities certified annually by an expert for compliance with the requirements of the ElektroG (technical requirements as well as requirements for the documentation of all primary data required for the calculation of recovery rates up to the recycler). Operators of primary treatment facilities fulfill this obligation, among other things, if they commission an expert with the certification who has been publicly appointed for WEEE disposal in accordance with § 36 of the Industrial Code.
However, operators of primary treatment facilities also fulfill this obligation if they commission an expert who is established in another EU/EEA country, who only occasionally and temporarily wants to certify primary treatment facilities in Germany and whose professional qualification required for this has been verified and confirmed by the competent authority.
The operator of an initial treatment plant must ensure that another expert certifies the plant at the latest after five years of continuous inspection by the same expert.
