Sewage sludge; request for the designation of a body to carry out sample testing.
The Sewage Sludge Ordinance requires the sewage sludge producer to have certain sample tests performed on sewage sludge and application soils for sewage sludge.
The pollutant-related sample tests on soil, sewage sludge, sewage sludge mixture and sewage sludge compost required by the Sewage Sludge Ordinance may only be carried out by bodies that have been designated by the competent authority or that have equivalent recognition from another EU or EEA state.
The Sewage Sludge Ordinance obliges the sewage sludge producer to have certain sample tests carried out on sewage sludge and application soils for sewage sludge. These tests may only be carried out by testing laboratories that have been designated (notified) by the competent authority.
The competent authority checks whether the requirements for designation (notification) of the applicant as an investigation body for certain investigations provided for in the Sewage Sludge Ordinance are met (cf. "Requirements" below).
A body is considered to be officially designated even if it operates in Bavaria and therefore does not require designation by a Bavarian authority if it has been designated by a competent authority of another federal state or if it has equivalent recognition from another EU or EEA state. In the latter case, the foreign body must submit the equivalent foreign recognition to the competent German authority before commencing its activities in Germany.
A testing body (applicant) is designated (notified) for certain sample testing of soil, sewage sludge, sewage sludge mixture and sewage sludge compost provided for under the Sewage Sludge Ordinance if the applicant is
- is reliable
- has the necessary independence for the investigations
- has the necessary expertise for the respective tests
- has the required technical equipment for the tests
- has demonstrated in regular quality assurance measures that he possesses the necessary technical competence
- has introduced a quality assurance system according to DIN ISO EN 17025 and
- can provide evidence of successful participation in the Interstate Interlaboratory Test (LÜRV).
The applicant does not have to observe any deadlines when submitting an application for designation (notification) as a body for certain investigations.
In case of existing notification, the application for extension shall be submitted to the competent body in due time before the expiry of the validity of the notification notice.
