Private supplementary school; notification of establishment and subsequent substantial change
Depending on the jurisdiction, the State Ministry of Education and Cultural Affairs or the government examines notifications of the establishment of supplementary schools and in the case of subsequent substantial changes.
Description
Depending on the jurisdiction, the State Ministry for Education and Cultural Affairs or the government, in accordance with Art. 102 (2) and (3) of the Bavarian Law on Education and Teaching (BayEUG), examine notifications of the establishment of supplementary schools and of subsequent significant changes. The establishment of a supplementary school is to be notified at least three months before classes begin. The notification must include the curriculum as well as evidence of the school authority, the school facilities and the qualifications of the head teacher and the teaching staff. Subsequent substantial changes shall be notified as soon as possible, together with the supporting documents.
The governing body, the head, the teaching staff or the facilities of the supplementary school shall meet the requirements prescribed by law or by virtue of law or which are to be imposed on them for the protection of the pupils. The establishment and operation of a supplementary school may be prohibited by the school supervisory authorities if the aforementioned requirements are not met and the deficiencies have not been remedied within a specified period despite a request to do so by the school supervisory authorities. In analogous application of Art. 95 BayEUG, the school supervisory authority may prohibit head teachers, teachers and educators from carrying out their duties if they exhibit behaviour which would justify termination of employment in the case of contractually employed head teachers, teachers and educators at public schools, or if the school is being operated without the necessary approval.
The notification of the establishment of the supplementary school or of subsequent substantial changes can be handled via a uniform office in accordance with the provisions of the BayVwVfG, which acts as an intermediary between the notifying party and the competent school supervisory authority. If the procedure is used via the uniform body, the latter receives the notification and the legally required evidence, such as curricula and evidence about the school authority and the institution, in accordance with the procedural regulations in Art. 71a ff. BayVwVfG and forwards them to the competent school supervisory authority without delay. Notifications from the competent school supervisory authority to the person required to notify shall also be passed on to the person required to notify via the uniform office for handling the notification obligation in the event that the person required to notify has called in the uniform office for handling the notification obligation. This does not entail a change in the responsibilities of the school supervisory authorities.
Deadlines
The establishment of a supplementary school must be notified at least three months before the start of teaching. Subsequent substantial changes must be notified as soon as possible, together with the supporting documents.
