Cross-check experts; application for approval
Private experts need to be licensed to test officially left samples.
Description
During official sampling as defined in Section 43 of the German Food and Feed Code (Lebensmittel- und Futtermittelgesetzbuch, LFGB) (as well as of tobacco and tobacco products), additional duplicate samples are taken for any follow-up examinations, which are left behind at the plant. Only approved experts are authorized to examine these duplicate samples.
Private experts require approval for the examination of officially left samples. In Bavaria, this approval is granted by the Government of Upper Franconia.
The approval authority checks whether the applicant meets the approval requirements of the Ordinance on the Approval of Private Counter-Sample Experts and on Regulations for Official Counter-Samples and on the Amendment of the Federal Counter-Sample Expert Testing Laboratory Ordinance.
Prerequisites
Vocational training
- Food chemists with a state examination to become a state-certified food chemist or
- Approved veterinarians with a qualification as a specialist veterinarian in the field of investigation applied for admission or as a specialist veterinarian for public veterinary affairs or
- Persons with a university degree in natural sciences with relevant technical and legal knowledge.
Further requirements for the applicant
- at least two years of examination and assessment experience in the requested examination field/area
- has an accredited testing laboratory at his/her disposal
- reliable
- free from conflicts of interest in the performance of his/her duties as a counter-sample expert
- does not work in the official monitoring of food, feed and consumer goods

Professional qualification

Proof of 2 years' experience in examination and assessment (Annex 1 to Section 2(1) of the GPV).

Proof of accreditation (certificate / recognition) of the designated testing laboratory

Submission of the declaration of commitment (Annex 3 to Section 3 (5) GPV)

If approval for microbiological tests is applied for, if applicable, the permit according to the Infection Protection Act
