Home workers; remuneration monitoring

Home workers and home-based tradesmen within the meaning of the Home Work Act, as well as persons who, because of their need for protection, are treated in the same way as those employed in home-based work, are subject to special statutory protection provisions.


The right to proper payment for home work is ensured by generally binding minimum wages in "binding determinations". These may also provide for the payment of a homeworking or expense allowance, increased vacation pay or additional vacation pay and capital-forming benefits. Collective agreements may contain similar provisions. The law provides for the payment of a vacation allowance, a holiday allowance and an economic security supplement in the event of illness (§ 12 of the Federal Vacation Act, §§ 10, 11 of the Continuation of Remuneration Act).

The proper payment of all amounts is monitored by state remuneration inspectors (§ 23 Home Work Act). The state can enforce the subsequent payment of shortfalls through the courts (§ 25 Home Work Act).

Companies providing home work are obliged to keep home work lists and pay books or pay slips, to display pay lists, to provide information on the type of home work and its accident and health hazards, to provide information to the state authorities, to observe special notice periods and to comply with the statutory provisions on protection of working hours and hazards (§§ 6 to 14, § 28, § 29f Home Work Act).

Pay monitoring is carried out by the labor inspectorates at the governments.
