Inclusion projects; application for funding by inclusion companies.
The Free State of Bavaria promotes the creation of permanent jobs subject to social insurance contributions for severely disabled people or people with equal status as well as the cooperation and joint employment of people with and without disabilities.
Description
Inclusion companies offer diverse and adequate employment opportunities to severely disabled persons and persons with equal status whose participation in other employment on the general labor market encounters particular difficulties due to the nature and severity of the disability or other circumstances.
The aim is to create permanent jobs subject to social insurance contributions for severely disabled people or people with equal status, as well as cooperation and joint employment between people with and without disabilities. In Bavaria, inclusion companies are predominantly small or medium-sized enterprises from various economic sectors.
Inclusion businesses differ from workshops for people with disabilities in that training and employment contracts are concluded with those affected, with all the rights and obligations arising from this under labor law, collective bargaining law and social law, and thus an employment relationship exists on the general labor market.
The Inclusion Office at the Bavarian Center for Family and Social Affairs (ZBFS) can support the establishment, expansion, modernization and equipment of an inclusion business, including business management consulting and special expenses, with funds from the equalization levy in accordance with SGB IX. Funding in Bavaria is provided in accordance with the "Guidelines for the Funding of Inclusion Projects".
In addition, the needs of individual severely disabled employees can also be taken into account as part of the individual case-related accompanying assistance in working life. Integration grants from the employment agencies under the Third Book of the Social Code are also eligible.
Prerequisites
The inclusive enterprise for which the benefit is requested must be
- be a legally and economically independent company, company-internal operation or department on the general labor market, and
- employ at least 30 percent severely disabled persons whose participation in other employment on the general labor market is likely to encounter particular difficulties due to the nature or severity of the disability or due to other circumstances, despite exhaustion of all support options and the use of specialist integration services.
As a rule, the proportion of severely disabled persons should not exceed 50 percent.
Procedure
The application must be submitted in writing or electronically to the locally responsible Inclusion Office.
In order to check the responsibility, it is possible that the ZBFS also contacts rehabilitation agencies, for example the Employment Agency or the German Pension Insurance, in the case of benefits for the special effort.
It is also possible that other agencies outside the ZBFS, e.g. the integration specialist service, will be commissioned to prepare a statement or an expert opinion.
Deadlines
In the case of a benefit for the construction, expansion, modernization as well as equipment of an inclusive business, i.e. an investment support, the application must be submitted to the Inclusion Office prior to the corresponding measure.
