Viticulture; grape harvest declaration and wine production declaration (maximum yield regulation per hectare)
Grapes, grape must, Federweißer and wine may be sold to others only in the quantity corresponding to the total yield per hectare of the winery.
Description
The area under vines that is decisive for the assessment of the total yield per hectare of a farm is the yield area. The maximum permitted yield per hectare is 90 hl per hectare for the specified wine-growing region of Franconia and 110 hl per hectare for the Bavarian part of the specified wine-growing region of Württemberg (Bavarian Lake Constance).
The maximum permitted yield per hectare represents the maximum annual marketing quantity of wine that may be marketed by the winery.
The quantity harvested in excess of the total yield per hectare of a winegrowing operation is referred to as excess quantity.
A distinction is made here between: Excess quantities that do not exceed the total yield per hectare by more than 20% and Excess quantities that exceed the total yield per hectare by more than 20%.Excess quantities that exceed the total yield per hectare by more than 20% may only be used for winemaking on the winery's own premises and must be distilled by December 15 of the year following the harvest (see information page "Distillation obligation").
If the quantity harvested on a winery does not exceed the total yield per hectare by more than 20%, this excess quantity may only be used on the winery's own premises for wine production and stored beyond the harvest year, used on the winery's own premises for the production of quality sparkling wine p. A. and stored beyond the harvest year. Marketing is only possible if in one of the following years the total yield per hectare falls below the value of 90 hl/ha. Marketing of the excess quantity is then possible to an extent corresponding to the difference between the harvest quantity and the permitted total yield per hectare. In addition, excess quantities up to 20% of the maximum per hectare may be distilled or used on the winery's own premises to produce grape juice. The marketing of these two products is possible without offsetting the permitted marketing quantity.
Prerequisites
Grape harvest declaration, wine production declaration and supplier register:
All natural or legal persons or their associations whose business comprises at least 10 ares of vineyard area, or who, irrespective of the size of the vineyard area, market all or part of their harvest, in whatever form, are obliged to declare. Exempt from the obligation to declare are the fully delivering members of producer groups or cooperatives, to whom they deliver their entire harvest.
