Description

The prevention procedure is a measure to (permanently) secure the jobs of severely disabled employees and employees with equal rights. The implementation is the responsibility of the employer.

Employers are obliged to carry out prevention in their companies and departments. The obligation applies to all employers, public and private, regardless of the employment obligation.

If difficulties arise in the work or other employment relationship due to personal, behavioral or operational reasons, which could lead to a threat to this relationship, the employer shall involve the representative body for severely disabled persons and the representative bodies named in Section 176 of Book IX of the Social Code as well as the Inclusion Office of the Bavarian Family and Social Affairs Center (ZBFS-Inclusion Office) as early as possible in order to discuss with them all possibilities and all available assistance for counseling and possible financial benefits with which the difficulties can be eliminated and the work or other employment relationship can be continued as permanently as possible.

In the event of incapacity for work, the employer must take action if employees have been incapacitated for work for six weeks within a twelve-month period. This applies to all employees of the company or department, regardless of whether they are severely disabled or not (for more information, see "Related topics").

The aim of the prevention procedure is to secure the job permanently by eliminating or mitigating the difficulties that have arisen. All possible and reasonable assistance should be used.
