Mining; declaration of the appointment of a supervisor
A supervisor (responsible person) can be appointed in accordance with §§ 58 ff of the Federal Mining Act to fulfill the duties arising from mining regulations and to manage and supervise the operation.
Description
The overall responsibility for safety and order in an operation subject to mining law lies first and foremost with the mine operator, represented by the company's board of directors or, in the case of legal entities and trading partnerships, the persons authorized to represent the company by law, the articles of association or the partnership agreement.
Responsibility for the management and supervision of individual parts of the operation can be delegated to other supervisors (responsible persons) (Sections 58 ff of the Federal Mining Act - BBergG). The application for the naming of the delegation of responsibility (appointment) must be made in writing (Section 60 (1) BBergG).
The duties and powers must be precisely described in the appointment; the powers must correspond to the duties. It must be ensured by internal instructions that the responsible persons can fulfill their tasks and exercise their powers.
