Maternity protection; notice of employment of pregnant or nursing woman
If one of your employees, students or pupils has informed you that she is pregnant or breastfeeding, you must report this to the relevant labor inspectorate.
If your employee has informed you that she is pregnant or breastfeeding, you as the employer must immediately notify the responsible trade supervisory office of the employment of the pregnant or breastfeeding employee with the woman's name and employment data.
The same applies to schools and universities. These must also notify the relevant trade supervisory office of their pregnant or breastfeeding female pupils/students in accordance with their employment status if they are participating in compulsorily prescribed training events or completing a compulsorily prescribed internship.
In the notification to the relevant trade supervisory office, we recommend that you also provide information on the type and duration of the employment or (high) school education of the pregnant or breastfeeding woman. This may save the trade supervisory office from having to make further inquiries.
In addition, the responsible trade supervisory office must also be notified if you as an employer intend to employ a pregnant or breastfeeding woman on Sundays and public holidays or with clocked work.
Employing a pregnant or breastfeeding woman after 8 p.m. is generally not permitted. If you as an employer intend to employ a pregnant or breastfeeding woman until 10 p.m., you must apply for a permit to do so from the labor inspectorate. You can find more details about the application requirements and application forms on the websites of the district governments - Trade Inspectorate.
Schools or universities that employ a pregnant or breastfeeding pupil or student at night between 8 p.m. and 10 p.m. or on Sundays and public holidays must also notify the trade supervisory authority. There is no additional permit requirement for night work.
Your coworker, student, or pupil has informed you that she is pregnant or breastfeeding.
Notification of the employment or activity of a pregnant or breastfeeding woman must be made online to the trade supervisory office at the district government with regional jurisdiction for the place of employment or place of training and study of the pregnant or breastfeeding woman (see under "Online procedure").
The forms provided under "Forms" are to be used for the supplementary notifications to the trade supervisory office.
The notification must be made immediately after the employee announces the pregnancy or breastfeeding to the employer or, in the case of a student, to the school/college. If the pregnancy has already been reported, additional notification of the breastfeeding period is no longer necessary.
