Integration projects; application for funding by inclusion companies
The Free State of Bavaria promotes the creation of permanent jobs subject to social insurance contributions for severely disabled persons or persons with equal status as well as the cooperation and joint employment of persons with and without disabilities.
Description
Inclusion enterprises offer diverse and adequate employment opportunities to severely disabled persons and persons with equal status whose participation in other employment on the general labour market encounters particular difficulties due to the nature and severity of the disability or due to other circumstances.
The aim is to create permanent jobs subject to social security contributions for severely disabled persons or persons with equal status, and for persons with and without disabilities to work together and be employed jointly. In Bavaria, inclusive enterprises are predominantly small or medium-sized enterprises from various economic sectors.
Inclusion enterprises differ from workshops for people with disabilities in that training and employment contracts are concluded with the persons concerned with all the rights and obligations arising from this under labour law, collective bargaining law and social law, and thus an employment relationship exists on the general labour market.
The Inclusion Office at the Bavarian Family and Social Affairs Centre (ZBFS) can promote the establishment, expansion, modernisation and equipment of an inclusion business, including business management advice and special expenses, from funds from the equalisation levy in accordance with Book IX of the Social Code. Funding in Bavaria is provided in accordance with the "Guideline for the funding of integration projects".
In addition, the needs of individual severely disabled employees can in principle also be taken into account within the framework of individual case-related accompanying assistance in working life. Integration grants from the employment agencies under the Third Book of the Social Code are also eligible.
Prerequisites
The inclusive enterprise for which the benefit is requested must be
- be a legally and economically independent enterprise, company-internal operation or department on the general labour market, and
- employ at least 30 per cent severely disabled persons whose participation in other employment on the general labour market is likely to encounter particular difficulties due to the nature or severity of the disability or due to other circumstances, despite the exhaustion of all support options and the use of specialist integration services.
As a rule, the proportion of severely disabled persons should not exceed 50 per cent.
Procedure
The application must be submitted in writing or electronically to the locally responsible Inclusion Office.
In order to check responsibility, it is possible that the ZBFS also contacts rehabilitation agencies, for example the Employment Agency or the German Pension Insurance Fund, in the case of benefits for the special effort.
It is also possible that other bodies outside the ZBFS, e.g. the specialist integration service, will be commissioned to prepare an opinion or an expert report.
Deadlines
In the case of a benefit for the construction, expansion, modernisation and equipment of an inclusive business, i.e. investment support, the application must be submitted to the Inclusion Office prior to the corresponding measure.
