Description

Prerequisites

You must notify the start of construction if:

• You start the execution of a construction project requiring a permit,
• you resume construction work after an interruption of more than 6 months, or
• you remove an installation subject to notification.

This also applies to projects covered by a partial building permit and to projects that do not require a permit.

Procedure

Written submission

• Submit the completed and signed "Notice of Commencement of Construction" form with the required attachments to the lower building inspection authority (district offices, independent cities, large district cities and certain larger municipalities).
• Verbal notification is not sufficient.
• You will not receive an acknowledgement of receipt.
• The lower building supervisory authority then checks whether the period of validity of the building permit has not yet expired. It may also prepare measures for construction supervision, if necessary.

Digital submission

Digital submission of notifications of the start of construction is currently not yet possible throughout Bavaria. This can only be done at certain lower building supervisory authorities. You can find out which these are in § 1 Digital Construction Application Ordinance. You can find the link under the tab "Legal basis".

• The start of construction can be notified digitally to the lower building supervisory authority using the online wizard.
• The predefined forms "Notification of start of construction" and (if required) "Determination of the responsible structural engineer for the construction" are replaced by the queries in the online assistant.
• Signatures are replaced by authentication using the user account "BayernID".
• The remaining attachments are uploaded in the online wizard in electronic form (files in PDF format).

Special notes

You must also indicate the "start of construction" if you are removing a facility and need to indicate this.

Deadlines

You must notify the start of construction at least one week before the start of work.

Remedy

Since no decision is issued by the lower building inspection authority, you cannot appeal.
