Earth excavation; display

Anyone drilling a well, constructing a well, or performing other work that penetrates so deeply into the ground that it may affect groundwater must report it to the authorities.

Description

Anyone who drills a borehole, constructs a well or carries out other work that penetrates so deeply into the ground that it may affect the groundwater must notify the responsible district administrative authority.

The obligation to notify is generally incumbent on the building owner. If the owner commissions a drilling company, the latter must inform the district administration authority.

Prerequisites

none

Procedure

Notification can be made in writing or, depending on the district administrative authority, electronically.

The notification is checked by the responsible district administrative authority, if necessary with the involvement of the water management office. It is examined with regard to restrictions on earth excavation at the planned location or whether the procedure must be discontinued.

Furthermore, it is decided within the scope of this examination whether further procedures must be carried out beyond the notification, e.g. a permit procedure under water law.

The responsible authority will inform the customer of the result in writing.

Special notes

In addition to the notification in accordance with the Water Resources Act/Bavarian Water Act to the district administrative authority, all earth excavations (boreholes, wells, etc.) must also be notified to the State Office for the Environment (LfU).

The notification to the LfU must be made at least two weeks before the start of the investigation. The LfU offers an online application for digital notification (see "Further links" and "Related services"). After completion of the work, all data obtained must be sent to the LfU.

Deadlines

Notification to the district administrative authority must be made at least 4 weeks before the start of the work.

Processing time

If you have not received a response from the responsible district administrative authority within four weeks of your notification (with complete documentation), you may begin work and continue until groundwater is impacted.

Fees

  • The costs depend on the type and purpose of the earth excavation as well as its dimensioning.

Remedy

Administrative court action
