Broadband expansion; application for the laying or modification of a telecommunications line in the public road network
If a telecommunications company wishes to use public street property to lay telecommunications lines or to modify lines that have already been laid, it must apply for approval under the Telecommunications Act.
Description
In principle, the use of public roads and their components is permitted to everyone within the scope of their dedication for traffic (public use). Public use primarily includes traffic in the narrower sense, i.e. in the sense of locomotion, change of location, transport. Any use that goes beyond the public use is a special use.
The use of traffic routes by telecommunications lines requires approval in accordance with the Telecommunications Act (TKG).
Prerequisites
You are a telecommunications company and would like to use a public road to lay or modify lines.
Procedure
The application for approval of the relocation must be submitted to the relevant road construction authority. For district roads, the district or the independent city is responsible, for municipal roads, the municipality, and for federal and state roads outside local thoroughfares, the state building authorities.
Deadlines
The approval must be granted prior to the construction work, therefore a timely application is required.
Fees
- The road authority shall charge fees and expenses for granting the consent.
