Regular public transport; application for permits and exceptions

The carriage of passengers by streetcars and motor vehicles for remuneration or on business is subject to the provisions of the Passenger Transportation Act (PBefG) and thus requires a permit.

Regular service means a regular transport service established between specified starting and ending points, on which passengers may embark and disembark at specified stops.

Governments

  • issue permits for international regular transport services,
  • issue permits for tariffs,
  • grant exceptions from the prohibition on taking other passengers on school bus and kindergarten routes in individual cases, and
  • promote entrepreneurs (compensation services, buses, depots, etc.).

The government may grant exemptions from the regulations applicable to regular services in specific individual cases or in general for specific applicants.

Prerequisites

The entrepreneur has to prove that

  1. the safety and efficiency of the business is guaranteed (submission of balance sheets, asset statements, etc.),
  2. he, the person appointed to manage the business and the transport manager are reliable (police certificate of good conduct, extract from the driver's suitability register, etc.),
  3. the professional qualification is given (certificate of professional competence from the Chamber of Industry and Commerce),
  4. he/she and the contractors commissioned by him/her to carry out transport services have their registered office or place of business within the meaning of commercial law in Germany.

In addition, the objective licensing requirements must be met (including public transport interests, local transport planning requirements).

Special notes

The Ordinance on the Operation of Motor Transport Companies in Passenger Transport (BOKraft) contains regulations that go beyond the Passenger Transport Act (PBefG) concerning:

  • the operation of motor vehicle companies
  • Behavior in the driving service

  • equipment and condition of vehicles
