The Free State of Bavaria supports so-called support centers for people with disabilities and day structure facilities for adult people with disabilities after working life (T-ENE) by granting facility operators subsidies for structural investments.

Description

Purpose

The funding is intended to enable the employment, stimulation and activation of people with disabilities outside their home or residential group in so-called support centers or T-ENE facilities.

Support center visitors are people with disabilities who do not or not yet meet the requirements for employment in a workshop and who can no longer find a place in the support group of a recognized workshop for the disabled (WfbM) - grouped together or divided into individual groups in the work area.

T-ENE visitors are older people with disabilities who have come to the end of their working lives, especially those who have left the WfbM or the Förderstätte. The aim is to provide them with assistance that meets their needs and enables them to organize their lives as individually as possible.

The support centers and T-ENE facilities are permanent institutions of integration assistance.

Support centers are independent facilities of integration assistance that cooperate with a recognized workshop in order to lead to the vocational training area of the workshop, to mitigate the consequences of the disability, to participate in life in the community and to relieve the burden on the family.

T-ENE facilities are independent institutions of integration assistance that offer people with disabilities in old age the choice between different offers according to their personal needs, so that this stage of life can be shaped as self-determined as possible in the sense of the UN Convention on the Rights of Persons with Disabilities.

Object

The (new) construction of support centers or T-ENE facilities is the object of the funding. The operation and ongoing (building) maintenance are not the subject of the funding. State subsidies are granted for support facilities in spatial connection with recognized workshops for disabled people (WfbM) or in spatial connection with inpatient residential places. In exceptional cases, the construction of a separate support facility is also eligible for funding, provided that it also cooperates with a recognized workshop.

The following are eligible for funding:

  • New construction, conversion, expansion, fundamental modernization (not renovation) and the equipping of support centers and T-ENE facilities,
  • Acquisition of a building, its conversion or repair.

Measures whose eligible expenses do not exceed 100,000 euros are not eligible for funding.

Recipients of funding

Applications may be submitted by non-profit organizations with legal capacity.

Type and scope of funding

The funding is provided in the form of a grant. The funding rate is up to 60% of the eligible expenditure. This application is made within the framework of financing, which assumes a 30% own contribution by the executing agency. Own contribution also includes funds from Aktion Mensch and similar funds granted to support own contribution.

The funding is provided in the form of project funding by way of partial funding VV No. 2.2.2 to Art. 44 Bavarian Budget Code (BayHO). The grant is limited to a maximum amount at the time of approval.

Prerequisites

The above-mentioned measures are subsidized in accordance with the Bavarian Budget Code if, among other things, the following conditions are met:

  • Recognition of need and approval of the location by the supra-local social welfare agency;
  • Submission of a concept that meets the requirements of the disability sector, also from the point of view of inclusion, and of a space and function program approved by the supra-local provider of integration assistance and the executive authority responsible for state funding, paying particular attention to the principle of economic efficiency and economy. As a matter of principle, the space and function program shall separately address multiple use of rooms and circulation areas with another facility;
  • Adherence to the DIN standard for handicapped-accessible construction to the extent required for the group of persons;
  • Guarantee that the sponsor can properly operate and maintain a support facility or T-ENE facility;
  • Proof of securing overall financing and at least 10% participation by the locally responsible districts.

Procedure

Application and approval procedure

  • Contact of the applicant with the responsible district administration for examination of the need and location and subsequent determination of the need by resolution.

  • Notification of the proposed project by the applicant to the agency responsible for funding.

  • In the case of future application with funding for land acquisition: investigation of the proposed land prior to acquisition for its suitability as a site for a facility for the disabled and cost review by the responsible agency and district. The suitability of the land is determined by the type and degree of use and by the building code requirements of the municipalities. For this reason, the suitability of the property should be coordinated with the municipal urban land use planning department as early as possible in order to clarify the requirements under planning law, such as the type and degree of use, urban integration, architectural design and development, in advance of the construction planning.

  • Preparation of a concept with a spatial and functional program by the applicant.

  • Technical consultation with the sponsor and review of the concept and the space and function program by the responsible body and the district.

  • Determination of the spatial and functional program in cooperation between the responsible agency and the district. This determination does not yet imply a funding commitment.

  • Entry of the applicant into the preliminary planning with cost-area determination and cost estimation according to DIN 276 as well as coordination with the granting authorities. The approval office also advises the sponsor on the basic technical and economic concept of the project and assesses the estimated expenditure.

  • The approval office acts in a coordinating capacity to secure the overall financing.

  • The approval office reports the project to the Bavarian State Ministry for Family Affairs, Labor and Social Affairs (StMAS) and, if the approval offices for housing promotion at the governments, the state capital Munich, the cities of Augsburg or Nuremberg are responsible, to the Bavarian State Ministry for Housing, Construction and Transport.

  • The approval office notifies a priority list regarding the projects planned in its area of responsibility by March 15 of the respective funding year at the latest, after consultation with the responsible district and the StMAS.
  • The StMAS decides on the inclusion of a project - within the framework of the available funds - in the annual funding program (JFP), taking into account the priority lists and according to the priority of the state in terms of disability. The decision on the respective JFP is made depending, among other things, on the preparation of the state budget. Projects that cannot initially be considered due to a lack of funds must be reapplied for in the following year and are again up for decision when the following JFP is drawn up.

  • The granting agencies inform the executing agency of the decision made and, after submission of the necessary application documents, in particular the concrete design input planning with cost calculation in accordance with DIN 276, as well as after a construction inspection, issue the notice of approval for the granting of the state subsidies (financing share of the StMAS). The district, which also participates in the investment funding, issues a separate notice of approval for its contribution - usually 10% of the eligible expenses.

    The funding from the StMAS is usually approved using commitment appropriations if it is not due for payment until future years. This represents a binding commitment of funds for the executing agency, so that it can start construction and be sure that these funds will then actually be disbursed in subsequent budget years. However, these state funds are not only paid out according to the progress of construction (this is a basic requirement), but can only be paid out successively within the framework of the expenditure funds available in the respective budget year and depending on the other projects also under construction. As a result, the executing agencies have to provide interim financing for some of their projects. This is expressly pointed out to the sponsors in the notice of approval.

    Insofar as the funding procedure is carried out by the housing promotion approval agencies, the notice of approved state funding is sent by the Bayerische Landesbodenkreditanstalt, which also handles the real security of the approved funding and disburses the funds.

Deadlines

The projects must be reported to the Bavarian State Ministry for Family, Labor and Social Affairs by March 15 of each year for inclusion in the annual funding program for that year by the granting agencies (see above). Thus, the projects should be reported to the governments by the applicants by mid-January of each year at the latest.

Processing time

For the above-mentioned procedure, at least 1 to 2 years are to be planned. If the project is included in the annual funding, the processing time from the application to the notification of approval is approx. 3-6 months.
