Food monitoring; control of tobacco products and related products, cosmetics and consumer goods

The official food monitoring controls not only food, but also consumer goods, cosmetics and tobacco products to ensure the protection of consumers.

Description

The term " consumer goods " as defined in Section 2 (6) of the German Food, Consumer Goods and Feed Code (Lebensmittel-, Bedarfsgegenstände- und Futtermittelgesetzbuch, LFGB) includes, among others

  • Materials or objects intended to come into contact with food (e.g. food packaging, cooking and tableware),
  • packages and containers intended to come into contact with cosmetic products (e.g. cream tubes)
  • articles intended to come into contact with the mucous membranes of the mouth (e.g. toothbrushes, toothpicks, tobacco pipes, cigarette holders)
  • Items intended for personal hygiene (e.g. combs, brushes, washcloths, towels)
  • Household cleaning products (e.g., laundry detergents, drain cleaners) and impregnation products (e.g., moth repellents, finishes)
  • Toys (e.g. dolls, paint boxes, stuffed animals) and joke articles
  • Articles intended to come into contact with the human body other than temporarily (e.g., clothing, jewelry).
  • Agents and articles intended to improve odors in rooms (e.g. room air sprays).

Cosmetic products are, according to Art. 2 para. 1 no. 1 of the Regulation (EC) no. 1223/2009 on cosmetic products (EU Cosmetics Regulation) substances or mixtures intended to come into external contact with the parts of the human body (skin, hair system, nails, lips and external intimate regions) or with the teeth and mucous membranes of the oral cavity for the sole or predominant purpose of cleaning them, perfuming them, changing their appearance, protecting them, keeping them in good condition or affecting body odor. These include toothpaste, soaps, creams, sunscreens, self-tanning lotions, lipsticks, nail polish, deodorants, perfumes, etc.... Cosmetic products must be distinguished from medicinal products, among others. The decisive factor for this differentiation is the intended purpose. Medicinal products are, in particular, substances intended to cure, alleviate or prevent diseases or pathological conditions.

According to Art. 2 of Directive 2014/40/EU, atobacco product is a product that can be consumed and that consists, even partially, of genetically modified or non-genetically modified tobacco.

Related products are understood to include electronic cigarettes, refill containers, and herbal smoking products (Section 2 No. 2 of the Tobacco Products Act (TabakerzG)).

Test results are published annually in the annual report of the Bavarian State Office for Health and Food Safety and in the Bavarian Consumer Information System (see "Further links").
