Waste management activity; application for a permit

If you want to collect or transport hazardous waste or trade in hazardous waste, you must apply for a permit for this activity from the competent authority.

Description

According to Section 54 (1) of the Closed Substance Cycle Waste Management Act (KrWG), collectors, transporters, traders and brokers of hazardous waste require a permit. The permit is to be granted if its requirements are met.

Various legal provisions stipulate that no permit is required for certain constellations of cases. These case constellations and underlying legal provisions are listed in Section 4.2 of Annex 2 of the Ordinance on Notification and Permits - AbfAEV - (Art. 1 of the Ordinance of 5.12.2013, BGBl I p. 4043) (see under "Legal Bases").

Prerequisites

Permission is granted upon fulfillment of the following requirements:

  • The applicant (in the case of legal persons and associations of persons, the person authorized by law, articles of association or bylaws to represent or manage the business) and the persons responsible for the management and supervision of the business must be reliable.
  • The applicant, insofar as he is responsible for the management of the company, and the persons responsible for the management and supervision of the company and the other personnel must have the necessary technical and expert knowledge for their activities.

Procedure

Submit the application together with the required documents to the competent authority.

The authority will send you an acknowledgement of receipt. After reviewing the application and your documents, the authority may

  • request additional documents or
  • grant the permit with or without additional conditions or
  • reject the permit.

  • Proof of business liability insurance and environmental liability insurance related to the respective activity

  • Proof of motor vehicle liability insurance

    (only for collectors and transporters of waste, insofar as they intend to transport waste on public roads)

  • Company-related information from the central business register (document type 9)

    only for applicants which are legal persons or associations of persons

  • personal information from the central business register (document type 9)

  • Certificate of good conduct (document type OG)

  • Information from the central business register and certificates of good conduct must be applied for by the applicant at the competent office and will be sent from there to the licensing authority.

  • Proof of specialist knowledge in accordance with § 5 Para. 1 Sentence 1 of the Ordinance on Notification and Licensing (in particular confirmation of participation in an officially recognised specialist knowledge course).

  • Foreign certificates from another EU member state or from another state party to the Agreement on the European Economic Area
