Minimum safety altitude for flights under visual flight rules; application for permission to fly below it
Permission to fly below the minimum safety altitude may be granted for flights for special purposes (e.g. aerial photography flights, film flights).
Description
Except when falling below is necessary for takeoff or landing, the minimum safety altitude to be maintained when operating aircraft under visual flight rules is 300 m (1,000 ft) above the highest obstruction within 600 m (1,000 ft) of the aircraft over cities, other densely populated areas, and outdoor crowds. In other cases, the altitude is 500 ft (150 m) above the ground or water, or 500 ft (150 m) above the highest obstruction within 500 ft (150 m) of the aircraft.
Upon request, the air traffic control authorities may grant permission to fly below the minimum safety altitude for flights for special purposes (e.g. aerial photography flights, film flights).
Prerequisites
A permit can only be issued at due discretion if in particular
- safe flight operations are guaranteed
- dangers to the general public can be ruled out
- adequate protection against aircraft noise is provided, and
- the careful treatment of nature and the landscape is ensured.
This public interest and the applicant's interest in carrying out the project (purpose of the flight) must be weighed against each other. Decisive factors include the intensity, the location and the date of the project.
