Since 01.11.2015, the housing provider is obliged to cooperate in the registration of an apartment. Section 19 of the Federal Registration Act stipulates that the housing provider or a person appointed by the housing provider must issue a confirmation of move-in to the person required to register for submission to the registration office:
The housing provider is the person who makes the dwelling (a dwelling within the meaning of the Federal Registration Act is any enclosed space used for living or sleeping) available. Housing providers are primarily landlords or their agents, e.g. housing administrators. Housing providers may also be primary tenants who sublet living space.
The housing provider confirmation must contain the following information:
- Name and address of the housing provider and, if the housing provider is not the owner, also the name of the owner
- the date of the actual move-in
- the address of the apartment
- the names of all persons subject to registration who are moving in
The mere submission of the lease agreement does not meet the requirements determined by law, as it usually does not contain all the required information.
The confirmation of the landlord can also be made electronically to the registration office.
In this case, you will receive from your landlord a so-called assignment feature, which was previously communicated to him by the registration office. If the landlord or a person authorized by him refuses to issue the confirmation or if it is not possible for you to receive the confirmation (in time) for other reasons, you must inform the registration office immediately.
