If your municipality has provided for this in its water supply statutes, properties that are served by pipes of a public water supply facility must generally also be connected to this facility and use it. This obligation is referred to as the so-called connection and use obligation.

The possibility of imposing such an obligation on property owners for reasons of public welfare is regulated by law in the Municipal Code (GO). Article 24, Paragraph 1, No. 2 of the GO allows municipalities to perform this duty using this route. This provision forms the basis for corresponding regulations under local law in the municipal water supply statutes to order compulsory connection and use.

Under certain conditions, however, property owners can also be exempted in whole or in part from the obligation to connect or use water, or they can be granted a restriction of the obligation to use water.
