District law; enactment of statutes and ordinances
Counties have two options for legislative action: They can issue statutes and ordinances. Both are regulations that establish binding legal consequences for everyone, in particular rights and obligations.
Description
The counties may enact bylaws to regulate their own affairs. For example, they can use statutes to regulate the use of their property and public facilities or, for reasons of public welfare, order the compulsory connection and use of their facilities. Examples of this are bylaws in the area of waste management.
Statutes regulating delegated matters as well as statutes which threaten violations of their regulations with a fine (= reinforced statutes) are only permissible in the cases specified by law.
The procedure for enacting bylaws is regulated in the Landkreisordnung für den Freistaat Bayern.
In addition, counties may also enact ordinances if provided for by law. General regulations on the procedure for enacting municipal ordinances can be found in the State Criminal and Ordinance Law (LStVG). The LStVG and other laws also contain authorizations for the enactment of ordinances by the county in the area of public safety and order.
