Chamber of Patent Attorneys; application for admission as a European patent attorney
The permanent establishment of a European patent attorney to practice in Germany requires admission to the Patent Attorneys' Association.
Description
European patent attorneys who are admitted to practice in another EU member state in which the profession of patent attorney is regulated may establish themselves in Germany to practice as European patent attorneys if they are admitted to the Patentanwaltskammer.
After admission to the Chamber of Patent Attorneys, you are entitled to practice in Germany under the professional title of your country of origin for the purpose of providing legal services in the field of foreign and international industrial property protection. The country of origin must be indicated in German. As a member of the Chamber of Patent Attorneys, you are bound by the professional rights and duties of a patent attorney. However, you are not allowed to advise or represent clients in the field of German intellectual property rights, even after admission to the Patent Attorneys' Association.
The application for admission to the Chamber of Patent Attorneys must be addressed to the Chamber of Patent Attorneys. The Chamber of Patent Attorneys is a federal corporation under public law, which is supervised by the President of the German Patent and Trademark Office.
Prerequisites
The prerequisite for admission to the Chamber of Patent Attorneys is the submission of a certificate from the competent authority in the country of origin confirming membership of the profession and proof of citizenship. The certificate must be submitted to the Chamber of Patent Attorneys annually without being requested to do so.
Those admitted to the Chamber of Patent Attorneys shall indicate their country of origin when using their professional title. They are entitled to use the designation "Member of the Chamber of Patent Attorneys" in their professional dealings.

Original certificate of the competent authority in the home country on the existing affiliation to the foreign patent attorney profession
(The certificate must not be older than three months at the time of its submission. Important: The certificate issued by the competent authority in the home country on the affiliation to the foreign patent attorney profession must be resubmitted annually without being requested to do so).

Proof of professional liability insurance pursuant to Section 158 (3) sentence 2 PAO in conjunction with Section 21 (2) sentence 1 EuPAG and Section 45 PAO or a provisional confirmation of coverage, in each case in the original
The minimum sum insured is 250,000 euros for each insured event.

employment contract and declaration of exemption, if applicable
(If you are in a permanent employment relationship with a company, a copy of the employment contract must be submitted as well as a signed original declaration of the employer, bearing the company stamp, that there are no obstacles to the practice of the profession of patent attorney. Please use the template prepared by the Board of the Chamber of Patent Attorneys, available at the office of the Chamber. The documents serve to determine whether there is a ground for refusal within the meaning of Section 14 No. 8 PAO).

If applicable, a publicly certified copy of the doctoral certificate or further proof of the acquisition of academic degrees and titles.

Please note that the Chamber of Patent Attorneys may require a certified translation into German if documents are submitted in a foreign language.
