In Bavaria, waste disposal is the responsibility of the districts and municipalities. For waste from private households, among other things, there is a basic obligation to use the municipal facility. In order to carry out their tasks effectively, the facility operators can form special-purpose associations or commission a private third party, including a limited liability company (GmbH), to actually carry out the waste disposal.
The public waste disposal operators regularly refinance themselves through waste disposal fees. In addition to ongoing operating costs, these also include annual depreciation on capital expenditure and provisions for future refurbishment costs.
When calculating the fees, the facility operators have a certain amount of leeway in the extent to which they charge uniform fee rates or separate fee rates for different services (e.g. organic waste garbage can, bulky waste disposal).
