Waste fees; payment
Fees are charged for the disposal of waste. The person liable to pay fees is the person who uses the waste disposal facilities of the district or the independent city.
In Bavaria, waste disposal is the responsibility of the counties and municipalities. For waste from private households, among other things, there is a basic obligation to use the municipal facility. In order to carry out their tasks effectively, the facility operators can join together to form special-purpose associations or commission a private third party, including a limited liability company (GmbH) supported by the facility operator, to actually carry out the waste disposal.
The public waste management authorities regularly refinance themselves through waste disposal fees. In addition to ongoing operating costs, these also include annual depreciation on capital expenditure and provisions for future refurbishment costs.
When calculating the fees, the facility operators have a certain amount of leeway as to whether they charge uniform rates or separate rates for different services (e.g. organic waste garbage can, bulky waste disposal). The relevant usage and fee statutes of the respective facility providers are authoritative.

The fees are levied by means of a fee notice, against which an objection and/or an action for annulment are admissible. After the notices have become effective, corrections are regularly at the discretion of the responsible authorities.
