Landscape protection areas; application for designation
Landscape protection areas, in comparison to nature reserves, serve primarily to protect the natural balance and its functionality.
Description
In addition to flora and fauna, important protected assets include soil, groundwater and surface water, climate and the landscape. An area can also be designated as a landscape protection area due to its special importance for recreation. Likewise, areas in which nature-compatible use by humans is to be preserved or reintroduced can be placed under landscape protection. Compared to nature reserves, the focus is on abiotic resource protection.
As self-governing bodies, the counties and independent cities are responsible for establishing landscape protection areas by legal ordinance. If the landscape protection area goes beyond the territory of a county or an independent municipality, the district is responsible for issuing the protected area ordinance.
Protected areas can be divided into zones with correspondingly graduated protection. Where necessary, their surroundings may also be protected.
Special notes
The state government is responsible for issuing legal ordinances on national parks. Legal ordinances on nature reserves are issued by the higher nature conservation authority at the government (see under "Related topics").
The district administrative authorities (district offices and municipalities) are responsible as lower nature conservation authorities for issuing legal ordinances on natural monuments and for issuing legal ordinances on protected landscape elements up to a maximum size of 10 hectares.
