Species protection in road planning; notes on the compilation of nature conservation data.
Special species protection is taken into account in road planning. Guidance is available on the preparation of nature conservation information for special species protection assessment in state road planning.
Description
The necessity of an "examination under species protection law" within the framework of planning procedures results from the prohibitions of § 44 paragraph 1 and 5 of the Federal Nature Conservation Act. As a working aid for the consideration of these requirements for species protection in road approval procedures, the then Supreme Construction Authority in the Bavarian State Ministry of the Interior, for Construction and Transport, in coordination with the Bavarian State Ministry for the Environment and Consumer Protection, published the "Notes on the preparation of information on nature conservation for the special species protection assessment in road construction - saP" (version as of 01/2015). These were adapted in August 2018 by the Bavarian State Ministry for Housing, Construction and Transport to the amendment of the Federal Nature Conservation Act of 15.09.2017 in § 44 para. 5 BNatSchG (see "Further links").
Prerequisites
The use of the work aid requires relevant nature conservation, legal and biological expertise. It is intended for specialists in landscape planning and biology.
