Motor vehicle; application for an exemption in the event of technical deviations

If vehicles deviate from the construction or operating regulations of the Road Traffic Licensing Regulations (StVZO), they may only be placed on the market if an exemption has been granted.

Description

The Government of Upper Palatinate is responsible for approving exemptions from the provisions of §§ 16 to 22a Para. 1, §§ 29, 32, 34, § 52 Para. 3, 3a and 4, § 57a StVZO and from all other provisions of Part B of the StVZO, unless the exemptions are applied for on the occasion of the allocation of an official license plate (registration) or the granting of an operating license, and generally for motor buses for the commercial transport of passengers.

The district administrative authorities are responsible for approving all regulations of Part B of the StVZO, unless the governments are responsible.

Prerequisites

Approval of an exception may be considered to take account of special exceptional situations that cannot be adequately accommodated by strict application of the statutory provisions.

In the case of exceeding dimensions and weights, for example, it is a prerequisite that the transport of an indivisible load requires the use of a vehicle that exceeds the usual standards of the StVZO.
