Motor vehicle; application for a derogation in the case of technical derogations
If vehicles deviate from the construction regulations of the Road Traffic Licensing Regulations (StVZO), they can only be put into circulation if a special permit has been issued. The same applies if the operation of the vehicle is to deviate from the operating regulations of the StVZO.
The Government of the Upper Palatinate is responsible for approving exemptions from the provisions of §§ 16 to 22a Para. 1, §§ 29, 32, 34, § 52 Para. 3, 3a and 4, § 57a StVZO and from all other provisions of Part B of the StVZO, unless the exemptions are applied for on the occasion of the allocation of an official registration plate (approval) or the granting of an operating licence and, in general, in the case of buses for the commercial carriage of passengers.
The district administrative authorities are responsible for approving all regulations of Part B of the StVZO, unless the governments are responsible.
Approval of an exception may be considered in order to take account of special exceptional situations which cannot be adequately taken into account by strict application of the legal provisions.
In the case of exceeding dimensions and weights, for example, it is a prerequisite that the transport of an indivisible load requires the use of a vehicle that exceeds the usual standards of the StVZO.
