Description
Specialized operation means any operation, other than a commercial operation, in which the aircraft is used for specialized activities, such as agriculture, construction, aerial photography, surveying, observation and surveillance, or aerial advertising.
Specialized air operations may be commercial or noncommercial.
Commercial Specialized Flight Operations
Commercial specialized flight operations have been subject to declaration requirements since April 21, 2017.
Accordingly, corresponding flight operations are permitted if a declaration has been made to the competent aviation authority in accordance with ORO.DEC.100 of Regulation (EU) No. 965/2012 on the conduct of commercial specialized flight operations. In it, you declare that the relevant organizational requirements have been met and that the management system documentation, including the operations manual, complies with the applicable requirements of Regulation (EU) No. 965/2012. Upon receipt of your complete declaration, you will receive a written confirmation in accordance with ARO.GEN.345 of Regulation (EU) No. 965/2012.
Non-commercial specialized flight operations with other than technically complex aircraft.
These are, for example, competition and display flights, flights for the purpose of dropping parachutists, flights for towing gliders and aerobatic flights, provided that they meet the requirements of SPO.GEN.005 letters b) and c) of Regulation (EU) No. 965/2012.
In these cases, the conduct of flight operations is governed by Annex VII (Part-NCO) of Regulation (EU) No. 965/2012. The submission of a declaration in accordance with ORO.DEC.100 of Regulation (EU) No. 965/2012 is not required in these cases.
However, special reference is made to the requirements according to NCO.SPEC.105. According to this, a clear list must be drawn up for the respective type of specialized flight operation on the basis of a completed risk assessment and reviewed on a regular basis.
Compliance with the requirements is subject to ongoing supervision by the competent authority.
Procedure
The aviation authorities are responsible for receiving your declaration if you have your place of residence or business in Bavaria and the flight operation is conducted with aircraft other than technically complex aircraft (Def.: Art. 3 letter j of Regulation (EC) No. 216/2008) and exclusively according to visual flight rules. Otherwise, the Luftfahrt-Bundesamt is the competent authority.
The declaration must be submitted using the form provided (see under "Forms").
