Physician; notification of temporary and occasional provision of services
Doctors who wish to exercise the medical profession only temporarily and occasionally in Bavaria do not require a permanent professional licence in the form of the licence to practise medicine (Approbation), but may notify the competent authority in writing of the provision of services. This applies to nationals of EU/EEA states or Switzerland.
Anyone who wants to work as a doctor in Germany after studying human medicine usually needs a special professional license - the Approbation or a professional permit. In Bavaria, these are issued by the Government of Upper Bavaria and the Government of Lower Franconia.
In the case of a merely temporary and occasional medical activity (service), an Approbation or permit is not required for nationals of EU/EEA states or Switzerland. Rather, for the provision of services, a written notification of the intended activity to the competent authority (see under "Responsible for you") is sufficient, together with the submission of certain documents.
You must have completed medical training and have established yourself as a doctor in another EU member state. In addition, sufficient German language skills must be available.
The documents listed under "Required documents" must be submitted to the competent authority as part of the initial notification. The authority checks the documents and clarifies any doubts with the applicant or directly with the home state. Provided that the authority does not raise any concerns, the service may be provided.
The service provider has the rights and obligations of a physician when providing the service in Bavaria.
A service provider is exempt from membership in the medical professional representative body (medical district association).
Nevertheless, service providers must observe the professional duties of a doctor, which result from the Heilberufe-Kammergesetz and the Berufsordnung für die Ärzte Bayerns. Violations of professional duties can be prosecuted under professional law.
The notification must be submitted in writing to the competent government before the service is provided for the first time. The notification must be renewed once a year if the service is also to be provided in that year.
There is no statutory processing period. The processing time depends on the quality, in particular the completeness of the documents and the general workload of the authority.
- A fee of EUR 50 must be paid for the processing of the notification.
