Foreign academic degrees, university titles, and university job titles; Holding of titles
In the Free State of Bavaria it is permitted to hold foreign academic degrees or titles without need of prior authorization. No authorization procedures are conducted and no permits to hold a title are granted.
Since August 1st, 2003, it has been admissible in the Free State of Bavaria, by operation of law, to hold foreign academic degrees or titles without need of prior authorization. By virtue of the amendment to the Higher Education Act of the Free State of Bavaria effective June 1st, 2006, additional agreements by the federal states in the Federal Republic of Germany have been transposed into Bavarian federal state law; these additional agreements benefit notably the holders of certain of academic degrees or tiles titles hailing from the EU Member States compared to the previous legal situation.
The need for individual authorization procedures on a case-by-case basis is thus obviated. No applications are necessary as a result. No permits to hold a title will be granted as they are excluded by law. This also applies in respect of other legally binding statements (administrative acts) on specific forms of holding academic titles.
Principles of the holding of titles
(cf. Art. 68 Para. 1 Sentences 1 and 2, Para. 3 of the Higher Education Act of the Free State of Bavaria)
It is permitted in the Free State of Bavaria, without need of prior authorization, to hold a foreign academic degree or title conferred either by a university recognized under the laws of the country of origin or by another body authorized to confer said academic degree or title, if the foreign academic degree or title was acquired by virtue of an actually completed academic degree program and a duly completed by a final examination, both in the form the academic degree or title was (originally) conferred and in the abbreviated form approved or certifiably customary in the country of origin, although it is mandatory in each case specifying the name of the awarding university.
Where required, it is permitted transcribe to this form of holding an academic title into Latin script and to add a literal translation (into the German language) in parentheses; in that case, the original form or the transcription into Latin script including the translation and specification of the university as a unit constitute the authoritative and relevant form of holding the academic title.
The same applies to foreign academic degrees conferred by government or church institutions, to foreign university titles and university job titles, and to foreign title identical in name to or confusingly similar to domestic academic degrees or titles.
The Bavarian State Department for Science, Research and Art has competence for approval procedures for the holding of foreign academic degrees only to the extent there is a legal entitlement to holding such a degree based on the Federal Refugees Act.
