Fireworks; notification of the burning of pyrotechnic articles
The form is used for the notification of fireworks with pyrotechnic objects by the holder of a permit under the Explosives Act (SprengG).
Description
However, it does not apply to the display of effects in theaters and comparable facilities. If you do not have a permit under the Explosives Act (SprengG), you need a permit from the local municipality if you wish to set off fireworks of category F2 in the period from January 2 to December 30.
Permit holders who have a permit according to § 7 or § 27 of the Explosives Act (SprengG) are obliged to report the intended fireworks to the Trade Supervisory Office in due time.
The basis for this is § 23 para. 3 of the 1st Ordinance to the SprengG.
Pyrotechnic objects are divided into different categories. The obligation to notify refers to the burning of pyrotechnic objects of the categories F2 (January 2 to December 30) and F3, F4, P1, P2, T1 and T2 (all year round).
The notification must contain the contact details of the person responsible for the burning of the fireworks as well as the issuing authority, the date of issue and the number of the concession (permit according to § 7 or § 27 SprengG, certificate of competence according to § 20 SprengG).
In addition, the following information must be provided in the notification regarding the intended fireworks:
- Type of fireworks
- Place where the fireworks are to be set off
- Extent of the fireworks
- Beginning and end of the fireworks
- Safety measures
- Site plan with indication of protective distances
Prerequisites
The person making the notification must either be the holder of a permit under explosives law in accordance with § 7 or § 27 of the Explosives Act or, as a holder of a certificate of competence in accordance with § 20 of the Explosives Act, must act at least on behalf of the holder of a permit under explosives law in accordance with § 7 of the Explosives Act (so-called person responsible for setting off the fireworks).
Procedure
The notification with the required documents must be submitted to the trade supervisory office responsible for the place where the fireworks are to be set off.
The intended burning of fireworks only has to be notified, a permit is not issued by the trade supervisory office.
Special notes
If you do not have a permit under the Explosives Act, you need a permit from the local municipality if you wish to set off fireworks of category F2 in the period from 2 January to 30 December. Further information can be found under "Related topics" - "Fireworks; applying for a permit".
Deadlines
The notification must be received by the trade supervisory office at least 2 weeks before the burning date. If the fireworks are to be burned in the immediate vicinity of railroad facilities or airports, the notification period is 4 weeks.
Exceptions to the notification period are possible under certain circumstances. For this purpose, you have the possibility to apply for an exception from the notification period (shortening of the period) at the trade supervisory office. This application must contain a comprehensible justification and be received by the office as early as possible so that the office has sufficient time to process the application.
Fees
The use of the online procedure for the preparation of notifications is free of charge.
In case of shortening the deadline: in the standard case 150.00 EUR plus expenses (in case of increased effort deviations from this are possible).
Remedy
An action can only be brought if the deadline is shortened. In this case, an action can be brought against the decision within one month.
