Battery Act; application for confirmation of sufficient professional qualification of experts established abroad

In the case of experts for spent battery disposal established in other EU/EEA countries who only wish to carry out expert activities provided for in the Battery Act (BattG) in Germany on a temporary and occasional basis, the professional qualification required for this purpose will be verified and confirmed.

Description

In the procedure for the approval of a take-back system for spent portable batteries, the approval authority must rely on an expert opinion from an independent expert to determine whether the requirements for approval have been met (expected achievement of the collection targets and requirements for disposal and nationwide take-back, in each case in relation to spent portable batteries).

The take-back system must commission an expert with the appraisal who has been publicly appointed in accordance with § 36 of the Trade, Commerce and Industry Regulation Act for the disposal of used batteries.

However, these obligations are also fulfilled if an expert is commissioned who is established in a foreign country of the EU/EEA, who intends to carry out expert activities provided for in the Battery Act only occasionally and temporarily in Germany, and whose professional qualification required for this purpose has been verified and confirmed by the competent authority.

Prerequisites

In the review procedure, it is examined whether the above-mentioned expert has the professional qualification required for a publicly appointed expert for waste battery disposal.
