Description
The Ordinance on the Implementation of Energy Industry Regulations (AVEn), the former EnEV Competence and Implementation Ordinance (ZVEnEV), provides for the recognition of private experts who certify compliance with certain requirements of the Building Energy Act (GEG). For architects, experts are recognized by being entered in a list maintained by the Bavarian Chamber of Architects. Engineers are recognized by being entered in a list to be maintained by the Bavarian Chamber of Civil Engineers.
The decision on registration is made by a registration committee set up by the respective chambers. Its decision is an administrative act subject to a fee.
Prerequisites
In view of the importance of the activity to be carried out, the experts must have sufficient qualifications, which the registration committee checks and determines.
The experts do not have to be authorized to submit building plans or authorized to provide evidence within the meaning of Art. 61 Para. 2 of the Bavarian Building Code (BayBO). German citizenship or residence or a branch office in Bavaria are not required.
Engineers
The applicant must have a degree in engineering and be an engineer working in the construction industry within the meaning of Art. 5 para. 1 sentence 3 of the Building Chamber Act (BauKaG). According to this provision, engineers working in the construction industry are, in particular, engineers who work in one or more of the following fields: civil engineering, surveying, water management, transportation, engineering geology, building physics, energy, heating, air conditioning, supply and disposal, sanitary, telecommunications, electrical and lighting engineering, materials handling and storage technology or occupational safety in construction facilities. Applicants must have at least three years of continuous professional experience in the preparation or testing of certificates of structural and energy-saving thermal insulation (balance sheet procedure) or (and) in the energy planning or assessment of heating, cooling and ventilation systems and hot water supply systems.
Architects
The applicant must be entitled to use the professional title of architect in accordance with Art. 1 Para. 1 of the Building Chamber Act (BauKaG) and have at least three years of continuous professional experience in the preparation or examination of certificates of structural and energy-saving thermal insulation (balance sheet procedure).
