Description
The Ordinance on the Implementation of Energy Management Regulations (AVEn), the former Competence and Implementation Ordinance EnEV (ZVEnEV), provides for the recognition of private experts who certify compliance with certain requirements of the Building Energy Act (GEG). For architects, the recognition of experts takes place through registration in a list to be maintained by the Bavarian Chamber of Architects. For engineers, recognition takes place through registration in a list to be maintained by the Bavarian Chamber of Civil Engineers.
The decision on registration is made by a registration committee set up at the respective chambers. Its decision is an administrative act subject to a fee.
Prerequisites
In view of the importance of the activity to be performed, the experts must have sufficient qualifications, which the registration committee verifies and determines.
The experts do not have to be authorized to submit building documents or to provide evidence in the sense of Art. 61 Para. 2 of the Bavarian Building Code (BayBO). German citizenship or a residence or branch office in Bavaria are not required.
Engineers
The applicant must have a degree in engineering and be an engineer working in the construction industry as defined in Art. 5 Para. 1 Sentence 3 of the Baukammerngesetz (BauKaG). According to this provision, engineers working in the construction industry are in particular those engineers who are active in one or more fields of civil engineering, surveying, water management or transportation, engineering geology, building physics, energy, heating, air conditioning, supply and disposal, sanitary, telecommunications, electrical and lighting engineering, materials handling and storage technology or occupational safety at structural facilities. Applicants must have at least three years of related professional experience in the preparation or testing of proofs of structural and energy-saving thermal protection (balance procedures) or (and) in the energy planning or evaluation of heating, cooling and room air technology systems and hot water supply.
Architects
The applicant must be entitled to use the professional title of architect according to Art. 1 Para. 1 of the Building Chamber Act (BauKaG) and have at least three years of continuous professional experience in the preparation or examination of proofs of structural and energy-saving thermal insulation (balance method).
