Landscape element; determination
Parts of the landscape that are of special importance but do not meet the strict criteria of, for example, natural monuments, can be designated as landscape elements.
Description
In the interest of the natural balance or to revitalize the landscape, landscape elements can also be protected by legal ordinance. The parts of nature and landscape protected as landscape elements may not be destroyed or changed as a matter of principle.
The district administrative authorities (district offices and municipalities) are responsible as lower nature conservation authorities according to Art. 51 Para. 1 No. 5b BayNatSchG for issuing legal ordinances on protected landscape elements (§ 29 BNatSchG) up to and including 10 hectares in size.
For protected landscape elements larger than 10 hectares, the higher nature conservation authorities (= governments) are responsible according to Art. 51 Para. 1 No. 5c BayNatSchG.
