Purpose

The Free State of Bavaria grants subsidies to administrative districts and municipalities for the construction or extension of municipal roads, insofar as they are urgently required to improve traffic conditions.

Object

The following projects can be subsidised with funds from the Bavarian Municipal Transport Financing Act (BayGVFG):

  • the construction or extension of
    • roads with high traffic importance within the municipality
    • special lanes for buses
    • important feeder roads to the supra-local traffic network
    • important interurban roads
    • roads in connection with the closure of railway lines
    • dynamic traffic management systems
    • public interchange parking areas on roads
    • public transport areas for freight transport centres
  • crossing measures in accordance with the Railway Crossing Act or the Federal Waterways Act
  • Construction or extension of dependent footpaths and cycle paths in the local authority's charge in the thoroughfare of federal, state and district roads whose carriageways are not in the local authority's charge.

Construction is the same as new construction. Expansion means a structural change to existing traffic routes in terms of location, cross-section or load-bearing capacity, which is urgently required to improve traffic conditions. This also includes, among other things, the construction of traffic lights at junctions and an increase in the load-bearing capacity ("substance increase") of engineering structures.

Insofar as construction projects are development facilities pursuant to §§ 127 ff. of the Federal Building Code (BauGB), only the costs that are not attributable to the development expenditure can be funded.

Recipients of grants

Funding can be granted to administrative districts, municipalities and municipal associations if they are responsible for the construction of the roads eligible for funding.

Eligible costs

Reference is made to No. 6 of the Guidelines for Grants of the Free State of Bavaria for Road and Bridge Construction Projects of Municipal Construction Authorities (RZStra).

Type and amount

Funding will be granted on a pro-rata or fixed-amount basis in relation to the eligible costs. The amount of funding is determined in accordance with No. 7 of the RZStra.

Prerequisites

  • Due to the financial possibilities of the applicant, the project can only be realised if state subsidies are granted.
  • The remaining financing of the project or of a construction phase with its own traffic significance must be guaranteed.
  • The type and scope of the project must be urgently required to improve traffic conditions.
  • The requirements of regional and state planning must be taken into account and the other legal requirements must be fulfilled.
  • The project must be planned in such a way as to be flawless in terms of construction and traffic engineering, to protect the natural balance, the landscape and land as far as possible and to take account of the principle of economic efficiency and economy.
  • The needs of people with disabilities or mobility impairments must be taken into account.
  • The project must be coordinated in advance with urban development plans and measures connected with it.
  • The project must be provided for in a land use plan, a general transport plan or a plan equivalent to the assessment.
  • Funding from BayGVFG funds is only possible if the eligible costs exceed the de minimis limit of 100,000 euros, or more than 50,000 euros in the case of important inter-urban roads and footpaths and cycle paths in local thoroughfares of federal, state and district roads whose carriageway is not the responsibility of a municipality. There are no de minimis limits for interchange parking spaces and crossing measures under the Railway Crossing Act or the Federal Waterways Act.
  • The funding quota for new projects to be included in the BayGVFG programme is limited. A legal claim to funding within a certain period of time is not established by the inclusion in the programme. If demand exceeds this quota, the individual governments will set priorities.

The application for funding must be submitted to the responsible district government.

Deadlines

The project must not have been started yet. Please note that there is a submission deadline for applications for grants from BayGVFG funds. Applications must be submitted by 1 September of the year preceding the start of funding at the latest.
